Bergman Consulting welcomes Matthew Haskell as a Director.  Matthew obtained Bachelor's Degrees in both Political Science and Statistics from Columbia University.  He went on to earn his J.D. from Georgetown Law Center and practiced securities law prior to founding an investment firm.  See Matthew's bio

OCTOBER 2022

Jim Bergman testified as the defense economic damages expert for The Hillman Group against Hy-Ko Products Company.  After a one-week trial before U.S. District Court Judge Rodney Gilstrap in the Eastern District of Texas, the jury determined that Hillman infringed Hy-Ko's patents.  In its verdict, the jury found that Hy-Ko was not entitled to lost profit damages and awarded Hy-Ko a reasonable royalty 90% below its damages ask.  See Bloomberg Law article

Bergman Consulting welcomes Jacky Doan as a Financial Analyst.  Jacky obtained his Bachelor of Arts in Quantitative Economics from the University of California at Irvine, with a minor in Computer Science. JUNE 2022

The United States Court of Appeals for the Federal Circuit affirmed the $7.5 million judgment in the Pavo Solutions LLC v. Kingston Technology Company, Inc. patent case.  In its opinion, the Federal Circuit affirmed Mr. Bergman's reasonable royalty methodology, stating his methodology "correctly apportioned for non-infringing features" and is "exactly what our case law requires."  See Federal Circuit Opinion

FEBRUARY 2020

Jim Bergman testified as the economic damages expert for Pavo Solutions against Kingston Technology Company.  After a one-week trial before U.S. District Court Judge Josephine L. Staton in the Central District of California, the jury found that Kingston infringed Pavo's patent for a USB device with a swivel cover and ordered Kingston to pay a $7.5 million judgment.  Judge Staton subsequently upheld the jury verdict and affirmed Mr. Bergman's methodology. OCTOBER 2022

Jim Bergman testified as the economic damages expert in a one-week trial before U.S. District Judge Richard G. Andrews in the District of Delaware.  The jury found that Adobe infringed ViaTech Technologies patent regarding digital rights management and the ability to control access to digital content, and ordered Adobe to pay a $33.8 million judgment, adopting Mr. Bergman's reasonable royalty damage opinion to the dollar. Bergman Consulting welcomes Mario Avila as a Senior Financial Analyst.  Mario finished a dual-degree program earning his Bachelor of Science in Mechanical Engineering from Columbia University and Bachelor of Arts in Management-Engineering from Claremont McKenna College.  He went on to earn a dual Master of Science in Engineering & Technology Innovation Management and Master of Science in Mechanical Engineering from Carnegie Mellon University. Jim Bergman testified as the economic damages expert for Aqua Connect, Inc. against TeamViewer US, LLC.  After a one-week trial before U.S. District Court Judge Maryellen Norieka in the District of Delaware, the jury found that TeamViewer infringed Aqua Connect's patents regarding remote access to Apple systems and ordered TeamViewer to pay a $5.7 million judgment.  See Bloomberg Law article

Jim Bergman testified as the economic damages expert for Droplets, Inc. against Yahoo! Inc.  After a three-week trial before U.S. District Court Judge Jon S. Tigar in the Northern District of California, the jury found that Yahoo! infringed Droplets' patent regarding the use of interactive web links and ordered Yahoo! to pay a $15 million judgment.  See Bloomberg Law article

Jim Bergman testified as the economic damages expert for SPEX Technologies against Apricorn, Inc.  After a one-week trial before U.S. District Court Judge James V. Selna in the Central District of California, the jury found that Apricorn, Inc. infringed SPEX's patent related to hardware encrypted USB devices and ordered Apricorn, Inc. to pay a $3 million judgment based on Mr. Bergman's reasonable royalty analysis. JANUARY 2020

Jim Bergman testified as the economic damages expert in a two-week trial before U.S. District Judge Leonard P. Stark in the District of Delaware.  The jury found that VMware, Inc. infringed on two patents held by cloud infrastructure company Cirba Inc., which does business as Densify, and ordered VMware, Inc. to pay a $236 million judgment, adopting Mr. Bergman's reasonable royalty damage opinion to the dollar.
